1. Acceptance of Terms
By downloading, installing, or using the Pregnancy Test Scanner AI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Pregnancy Test Scanner AI is a mobile application that analyzes a photo of a home pregnancy test and gives you an AI-generated reading of the result. The App provides tools for scanning tests, viewing the result, and keeping a history of your scans.
3. User Accounts and Registration
3.1 Account Creation: You may be required to create an account to access certain features of the App. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Account Termination: You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Permitted Use
4.1 License: We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
4.2 Restrictions: You may not:
- Reverse engineer, decompile, or disassemble the App
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems
- Share your account credentials with others
- Use the App to store or transmit harmful content
5. User Content and Data
5.1 Your Data: You retain ownership of all photos, scan results, and personal information you input into the App ("User Content").
5.2 Data Storage: Your User Content is stored locally on your device and/or in secure cloud storage to enable synchronization across your devices.
5.3 Data Accuracy: You are solely responsible for the accuracy and completeness of your User Content, including the quality of the photos you submit. We do not verify or validate the information you provide.
5.4 Backup Responsibility: You are responsible for maintaining backups of any important data stored in the App.
6. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Medical Disclaimer
7.1 Not Medical Advice: The App is a tool that helps you read a home pregnancy test from a photo. It does not provide medical advice, diagnosis, or treatment, and it is not a medical device.
7.2 No Guarantee: We make no representations or warranties about the accuracy of readings, probabilities, or recommendations provided by the App. A reading can be wrong, including because of photo quality, lighting, test timing, or the condition of the test.
7.3 Professional Consultation: You should confirm any result with a healthcare provider before making decisions about your health, and consult a qualified medical professional with any questions about pregnancy.
8. Intellectual Property
8.1 Our Rights: The App, including its design, features, functionality, and content, is owned by us and protected by intellectual property laws.
8.2 Trademarks: All trademarks, service marks, and logos used in the App are our property or the property of their respective owners.
9. Disclaimers
9.1 Service Availability: We strive to maintain App availability but do not guarantee uninterrupted or error-free service.
9.2 Warranty Disclaimer: THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
12. App Store Terms
Your use of the App is also subject to the terms and conditions of the app store from which you downloaded the App (Apple App Store, Google Play Store, etc.).
13. Updates and Modifications
13.1 App Updates: We may release updates to improve the App's functionality, security, or performance. Some updates may be required to continue using the App.
13.2 Terms Updates: We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or other reasonable means.
14. Termination
14.1 Termination by You: You may stop using the App at any time by deleting it from your device.
14.2 Termination by Us: We may terminate or suspend your access to the App if you violate these Terms or for other legitimate business reasons.
14.3 Effect of Termination: Upon termination, your right to use the App ceases immediately. Data stored locally on your device may remain unless you delete it.
15. Governing Law and Disputes
15.1 Governing Law: These Terms are governed by the laws of Slovakia, without regard to conflict of law principles.
15.2 Dispute Resolution: Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the rules of Slovakia.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
